1. Acceptance of Terms
By creating an account and using AI Secretary, you confirm that you are at least 18 years old, have the legal authority to enter into this agreement on behalf of your business, and agree to be bound by these Terms. If you do not agree, you must not use the service.
2. Description of Service
AI Secretary provides an AI-powered scheduling assistant that:
- Answers inbound phone calls on behalf of your business
- Responds to inbound SMS messages from your customers
- Books, reschedules, and cancels appointments
- Sends appointment reminders and confirmations
- Provides mobile and web dashboards to manage bookings and conversations
- Stores your business context to enable accurate AI responses
3. AI Limitations & Your Responsibility
The AI assistant may misunderstand requests, provide incorrect information, or fail to complete bookings. You remain responsible for:
- Verifying appointments and customer communications
- Correcting any errors made by the AI assistant
- Maintaining your customer relationships
- Any consequences arising from AI-handled interactions
We are not liable for missed appointments, lost business, or customer disputes resulting from AI errors.
4. Acceptable Use
You must NOT:
- Deceive, harass, or defraud customers
- Misrepresent that an AI is a human when directly asked
- Use for spam or unsolicited communications
- Violate any applicable laws or regulations
- Attempt to hack or reverse engineer the service
- Resell or sublicense the service without written permission
5. AI Disclosure Obligation
You must ensure customers are aware they may interact with an AI assistant. We recommend an AI disclosure in your business communications and voicemail greeting.
6. Telecommunications Compliance
You must comply with all applicable telecommunications laws including TCPA (US), GDPR (EU), PECR (UK), CASL (Canada), and local regulations. Compliance is your sole responsibility.
7. Service Availability
We target 99.9% uptime but do not guarantee uninterrupted service. We are not liable for third-party outages (Twilio, Railway, Anthropic).
8. Payment & Billing
- Fees billed monthly in advance
- No refunds for partial months
- 30 days notice for price changes
- Service may be suspended after 7 days non-payment
9. Termination
We may suspend accounts that violate these Terms, engage in illegal activity, or fail to pay. You may cancel at any time. Data retained 30 days after termination for export purposes.
10. Limitation of Liability
We are not liable for indirect or consequential damages. Our total liability shall not exceed the amount you paid us in the 3 months preceding the claim.
11. Changes to Terms
We may update these Terms with at least 14 days notice via email or in-app notification. Continued use after changes take effect constitutes acceptance.
